Warren County Commissioners Public Meeting

January 9, 2019 12:00 p.m.

Main Courtroom

 

Commissioner Benjamin Kafferlin called the meeting of the Warren County Commissioners to order with Commissioner Cindy Morrison and Commissioner Jeff Eggleston present.

 

Staff Present: Pamela Matve, Chief Clerk; Eric Hern, Fiscal Director, Director, Ed Burris, Director of Veteran's Affairs, Lori Bimber, Register and Recorder, Brian Bull, Chief Assessor, and Phil Gilbert, Tax Claim Director

 

Citizens Present: Josh Cotton (WTO), Joe Scully, Connie Zaffino, and Nathaniel Schmidt

 

Announcements:

 

Commissioner Benjamin Kafferlin stated that there was one meeting in which all three Commissioners were together and that was right after the last public meeting in which the TAN documents for 2019 were signed.

Public Comment:

 

Connie Zaffino addressed the board asking about the right to know request she asked for back in July. A request of an extension was done, and granted, but as of this date I have not heard anything.

 

Eric Hern, Fiscal Director stated that he will look into this and get back to her. This was then corrected to state that he would get back with Ms. Matve who will in turn get back with Ms. Zaffino.

 

Joe Scully asked the commissioners if they could comment on her right to know request as to why she has not gotten an answer.

 

Commissioner Benjamin Kafferlin stated that he cannot as the Commissioners do not take part in this unless requested by Ms. Matve, Right to Know Officer.

 

Pamela J. Matve, Chief Clerk stated that videos were requested, and this must go through the labor attorney, and the Sheriff to approve letting videos go out as part of a right to know.

Minutes from the December 26, 2018 Meetings: Commissioner Cindy Morrison asked that Pamela J.         Matve, Chief Clerk read back the correction she asked to be made to which met with Commissioner Cindy          Morrison’s satisfaction.

 

Fiscal Report: Eric Hern, Fiscal Director stated there was cash on hand of $2,174,238.00.00 and in the       Erie bank account a balance of $197,510.00.

 

                Proclamation(s):  Commissioner Benjamin Kafferlin read the proclamation for School Choice Week, and Commissioner Cindy Morrison read a proclamation that she wrote for National Law Enforcement Day.

 

Motion was made by Commissioner Cindy Morrison, seconded by Commissioner Jeff Eggleston to approve today’s agenda, December 26, 2018 minutes, the fiscal report as presented, and the proclamation(s) as read. Motion carried unanimously.

 

Old Business:

 

Appointment of Phil Gilbert to the Warren County RDA: Commissioner Benjamin Kafferlin stated that this was tabled from the December 26, 2018 meeting. And as of today, no decision has been made.

 

 

 

 

New Business:

 

Appointment of Chief Clerk: Motion was made by Commissioner Benjamin Kafferlin seconded by Commissioner Cindy Morrison to appoint Pamela Matve as Chief Clerk for 2019. Motion carried unanimously.

 

Commissioner Jeff Eggleston stated that he looks forward to working with Pam in this year, and she does a wonderful job. Both Commissioner Benjamin Kafferlin and Commissioner Cindy Morrison agreed.

 

Appointment of Solicitor: Commissioner Benjamin Kafferlin stated that RFQ’s were opened at the December 26th meeting for County Solicitor. At the beginning of December Commissioner Benjamin Kafferlin received a letter from Attorney Shreve stating that he is looking to move onto another opportunity, and felt he could no longer be our solicitor. Therefore we went out for RFQ’s and Nathaniel Schmidt was the only submission.

 

Commissioner Benjamin Kafferlin then stated that he has spoken to Attorney Schmidt both by phone and in person, and he has hoped the others did also.

 

Motion was made by Commissioner Benjamin Kafferlin, seconded by Commissioner Jeff Eggleston to appoint Nathaniel Schmidt as Solicitor for Warren County. Motion carried unanimously.

 

Commissioner Jeff Eggleston thanked Solicitor Shreve for the work he has done for the County as Solicitor. Then welcomed Attorney Schmidt.

 

Commissioner Cindy Morrison welcomed Attorney Schmidt and stated it will be a refreshing change.

 

Joe Scully asked if Mr. Schmidt was a resident of Warren County. Attorney Schmidt state that he lived in the City of Warren.

 

Approval of the 2019Millage Rate: Commissioner Benjamin Kafferlin stated that today we are passing the 21.5 millage rate for 2019.

 

Motion was made by Commissioner Jeff Eggleston, seconded by Commissioner Benjamin Kafferlin to approve the 2019 millage rate at 21.5.

 

Commissioner Benjamin Kafferlin stated that the budget was built on maintaining the millage rate of 21.5. It has not changed from 2018.

 

Connie Zaffino stated that she saw on social media that this was not a tax increase. If the bond debt was paid off, and you are keeping the millage rate the same, how is not a tax increase?

 

Commissioner Benjamin Kafferlin stated that bottom line is that the tax millage for 2018 was 21.5 and for 2019 the tax millage is 21.5; no change.

 

Commissioner Cindy Morrison stated that you will pay the same taxes that you paid in 2018, but since the bond debt was paid off, taxes should have been reduced by 1 for a bottom line of 20.5. She then read a statement she prepared.

 

Commissioner Jeff Eggleston stated that it is difficult for all the details to be disseminated. By law we have to show bond debt as a separate line on the tax bills. All we are doing is reallocating the 1 mill to the real estate line. This is not the first time this has been done.

 

Commissioner Jeff Eggleston then further discussed his views on Commissioner Cindy Morrison’s statement. She wants to cut items such as Capital, Contingency, and Over Time etc. Commissioner Benjamin Kafferlin and I would also love to cut overtime, the two of us have had discussions with the department heads, we are not opposed to sitting down and working with Commissioner Cindy Morrison, but she has not given any written proposals for us to discuss.

 

Commissioner Cindy Morrison then rebutted by stating that the recordings need to be put on line so that the public can hear just what I stated, or anyone else. Commissioner Jeff Eggleston stated that these meetings are all on line. Commissioner Cindy Morrison stated that Work Sessions and Salary Boards need to be included. Commissioner Jeff Eggleston stated that they started out that way, but you stated that the only one that needs to be on line are the public commissioner meetings.

 

The discussions then turned back to the millage rate with contention.

 

Joe Scully stated to Commissioner Cindy Morrison that all the meetings are n you tube. Maybe we need to put a time clock in to show you are working. You call into work sessions; you were voted into office to work for the county, but you are never here.

 

Commissioner Cindy Morrison respectfully disagreed, and stated that while she may not be in the office, she is working for the tax payers every day.

 

After further discussions turning back to the millage rate, with Commissioner Jeff Eggleston stating that there was no promise made to reduce taxes once the bond debt was paid.

 

The above motion was called to question and the motion carried two to one with Commissioner Benjamin Kafferlin and Commissioner Jeff Eggleston for and Commissioner Cindy Morrison against.

 

Resolution #3128 Postponement of Delivery of Tax Duplicates: Motion was made by Commissioner Cindy Morrison, seconded by Commissioner Jeff Eggleston to adopt resolution 312 allowing the postponement of the tax duplicates. Motion carried unanimously.

 

Resolution #3129 Act 13 – Sugar Grove Twp. Request: Commissioner Benjamin Kafferlin stated that Sugar Grove Township is requesting $43,821.90 for the replacement of a bridge on Jones Hill Road. Commissioner Benjamin Kafferlin then stated that this will be the last request that can be accepted until the 2019 funding is received.

 

Motion was made by Commissioner Cindy Morrison, seconded by Commissioner Jeff Eggleston to approve Resolution #3129 for the request of ACT 13 funding from Sugar Grove Twp. in the amount of $43,821.90 for the bride replacement project on Jones Hill Road. Motion carried unanimously.

 

Approval of ABM funding source: Commissioner Benjamin Kafferlin stated that this item does not need action as at the last meeting we approved a resolution giving the Chief Clerk approval to sign on behalf of the county.

 

Motion was made by Commissioner Jeff Eggleston, seconded by Commissioner Benjamin Kafferlin to approve ABM funding source with First Internet Bank with an interest rate of 3.63%.

 

Commissioner Jeff Eggleston stated that he has reviewed the two proposals sent to us by ABM, and I feel that this is a good option. A huge chuck will be paid by the energy savings we will see.

 

Commissioner Benjamin Kafferlin continued by stating that with yesterday’s rain storm, I was called up stairs, right above this courtroom, and besides the current leaks, there are several new leaks that we now need to deal with. I urge the two of you to go upstairs and look at the problem we have. This is nothing short of necessary but you chose not to have the roof repaired over this part of the building as part of the ABM project.

 

The above motion was called to question and the motion carried two to one with Commissioner Benjamin Kafferlin and Commissioner Jeff Eggleston for and Commissioner Cindy Morrison against.

 

Approval of the Agreement between C&Y and Redwood Toxicology Labs: Motion was made by Commissioner Cindy Morrison, seconded by Commissioner Jeff Eggleston to approve the agreement between C&Y and Redwood Toxicology Labs. Motion carried unanimously.
